Agreement to Terms: By downloading, installing, or using VCook, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
1. Acceptance of Terms
Welcome to VCook! These Terms of Service ("Terms," "Agreement") govern your access to and use of the VCook mobile application ("App," "Service") provided by [Your Company Name] ("VCook," "we," "us," "our").
By creating an account, accessing, or using VCook, you agree to:
- Be bound by these Terms of Service
- Comply with our Privacy Policy
- Follow all applicable laws and regulations
- Be at least 13 years of age (or have parental/guardian consent if under 18)
We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the modified Terms.
2. Description of Service
VCook is an AI-powered recipe generation and cooking assistance application that provides:
- AI Recipe Generation: Create personalized recipes from text descriptions, dietary preferences, or food images
- Recipe Management: Save, edit, organize, and share your recipe collection
- Cooking Assistance: Step-by-step cooking guidance with timers, voice control, and Apple Watch integration
- Health Integration: Optional HealthKit integration for health-based recipe recommendations
- Menu Planning: Generate daily meal plans with breakfast, lunch, and dinner suggestions
- Recipe Sharing: Share recipes with other users via email or shareable links
- Recipe Translation: Translate recipes to multiple languages
VCook is available on a subscription basis with both free and premium tiers (see Section 4 for details).
3. Account Registration and Security
3.1 Account Creation
To use VCook, you must create an account by providing:
- A valid email address
- A secure password (for email registration)
- Or authentication through Apple Sign-In or Google Sign-In
You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Immediately notify us of any unauthorized access or security breach
- Be responsible for all activities that occur under your account
3.2 Account Eligibility
- Minimum Age: You must be at least 13 years old to create an account
- Minors (13-17): Must have parental or guardian consent to use the Service
- Accurate Information: You must not impersonate others or provide false information
- One Account Per Person: You may not create multiple accounts to circumvent usage limits or bans
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

4.2 Auto-Renewable Subscriptions
Premium subscriptions are auto-renewable, which means:
- Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle (monthly or annually) unless you cancel at least 24 hours before the renewal date
- Payment: Payment is charged to your Apple ID account at confirmation of purchase
- Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you initially paid
- Price Changes: If subscription prices increase, you will be notified in advance and must consent to the new price to continue
4.3 Free Trial (If Applicable)
We may offer free trials for new subscribers. Free trial terms:
- Free trial length (if any) is displayed at the time of subscription
- You will not be charged during the free trial period
- If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the regular price
- You must cancel at least 24 hours before the trial ends to avoid being charged
- Free trials are available only once per user/Apple ID
4.4 Managing Your Subscription
You can manage and cancel your subscription at any time:
- Open iOS Settings
- Tap [Your Name] → Subscriptions
- Select VCook
- Tap Cancel Subscription or change your plan
Important Notes:
- Cancellations take effect at the end of your current billing period
- You will retain premium access until the end of the paid period
- No refunds are provided for partial subscription periods
- Deleting the App does not cancel your subscription
- Deleting your VCook account does not cancel your subscription (you must cancel separately through iOS Settings)
4.5 Usage Limits
Premium Plan Daily Limit: Premium subscribers can generate up to 4 AI recipes per day (resets at midnight local time). This limit applies to:
- Text-to-recipe generation
- Image-to-recipe conversion
- Recipe translation requests
- AI cooking assistant queries
Free users cannot generate AI recipes. Exceeding daily limits will require you to wait until the next day or manually create recipes.
4.6 Refund Policy
All purchases are processed through the Apple App Store and are subject to Apple's refund policies. VCook does not directly process refunds.
To request a refund:
- Visit https://reportaproblem.apple.com
- Sign in with your Apple ID
- Find your VCook purchase and request a refund
Refund requests are subject to Apple's discretion. We do not guarantee refunds, but if you're experiencing issues, please contact our support team at vcook.innovation@gmail.com before requesting a refund.
4.7 Taxes
Prices shown do not include applicable taxes. Sales tax, VAT, GST, or other taxes may be added at checkout based on your location. You are responsible for any taxes associated with your purchase.
5. Acceptable Use Policy
You agree to use VCook only for lawful purposes and in accordance with these Terms. You agree NOT to:
5.1 Prohibited Content
- Create, upload, or share recipes containing illegal, harmful, offensive, or inappropriate content
- Infringe on intellectual property rights (e.g., copying copyrighted recipes without permission)
- Share content that promotes violence, hate speech, discrimination, or harassment
- Upload images of illegal substances, weapons, or other prohibited items
- Impersonate others or misrepresent your affiliation with any person or entity
5.2 Prohibited Activities
- Attempt to gain unauthorized access to the App, servers, or databases
- Reverse engineer, decompile, or disassemble the App
- Use automated bots, scrapers, or scripts to access the Service
- Interfere with or disrupt the App's functionality or servers
- Create multiple accounts to circumvent usage limits or bans
- Sell, resell, or exploit the Service for commercial purposes without authorization
- Use the App to distribute malware, viruses, or harmful code
- Collect user information without consent
5.3 AI-Generated Content Responsibility
- You are responsible for reviewing AI-generated recipes for accuracy and safety
- Verify ingredient safety, especially for allergies, dietary restrictions, or health conditions
- Do not rely solely on AI recommendations for medical or dietary advice
- VCook is not liable for health outcomes, allergic reactions, or injuries resulting from following AI-generated recipes
5.4 Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws and regulations while using VCook.
6. Intellectual Property Rights
6.1 VCook's Intellectual Property
The App, including its design, code, features, branding, logos, and content, is owned by VCook and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
You may not:
- Copy, modify, distribute, or create derivative works of the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use VCook's trademarks, logos, or branding without written permission
6.2 User-Generated Content
Ownership: You retain ownership of recipes, images, and content you create in VCook ("User Content").
License Grant to VCook: By creating User Content, you grant VCook a worldwide, non-exclusive, royalty-free, transferable license to:
- Store, display, and process your User Content to provide the Service
- Share your User Content with other users when you explicitly choose to share recipes
- Use anonymized and aggregated data to improve AI models and App functionality
Important: We do not claim ownership of your recipes. This license is solely to operate the Service (e.g., store your recipes in Firebase, generate AI recommendations based on your preferences).
6.3 AI-Generated Recipes
Recipes generated by AI using your inputs ("AI Recipes") are provided to you under a license for personal use. While you may use, modify, and share AI Recipes, please note:
- AI Recipes may inadvertently resemble existing recipes (AI models are trained on publicly available data)
- You are responsible for verifying that AI Recipes do not infringe on third-party copyrights before commercial use
- VCook does not guarantee the originality or uniqueness of AI-generated content
6.4 Copyright Infringement
If you believe content in VCook infringes your copyright, please contact us at vcook.innovation@gmail.com with:
- Identification of the copyrighted work
- Location of the infringing content in the App
- Your contact information
- A statement of good faith belief that use is not authorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
7. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using VCook, you consent to:
- Collection of information as described in the Privacy Policy
- Use of cookies and similar technologies by our service providers
- Transfer of data to the United States and other countries where our service providers operate
- Processing of data by third-party service providers (Firebase, RevenueCat, AI providers)
Key privacy commitments:
- We do not sell your personal information
- We do not share health data with third parties for marketing
- You can delete your account and data at any time
- You control what recipes you share with others

You acknowledge that:
- Third-party services have their own terms and privacy policies
- VCook is not responsible for third-party service failures or changes
- Service availability may change without notice
- Disputes with third parties are solely between you and that third party
9. Disclaimers and Limitations of Liability
9.1 "AS IS" Disclaimer
VCOOK IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Accuracy, reliability, or completeness of AI-generated recipes
- Uninterrupted, secure, or error-free operation
- Compatibility with all devices or operating systems
9.2 No Medical or Dietary Advice
VCook is not a substitute for professional medical, nutritional, or dietary advice.
- AI-generated recipes are for informational and entertainment purposes only
- Health-based recommendations (from HealthKit integration) are not medical advice
- Always consult a qualified healthcare provider, dietitian, or nutritionist for medical or dietary guidance
- Do not disregard professional medical advice or delay seeking it because of information from VCook
9.3 Recipe Accuracy and Safety
We do not guarantee the accuracy, safety, or suitability of any recipes (AI-generated or user-created):
- AI models may generate incorrect ingredient quantities, cooking times, or methods
- Recipes may not be suitable for your specific dietary needs, allergies, or health conditions
- You are solely responsible for verifying ingredient safety and following proper food handling practices
- VCook is not liable for allergic reactions, food poisoning, injuries, or property damage resulting from recipe use
9.4 Third-Party Service Failures
We are not responsible for:
- Failures or outages of third-party services (Firebase, AI providers, Apple services)
- Changes to third-party APIs or service availability
- Data loss due to third-party service issues
- Errors or inaccuracies in AI-generated content from third-party AI providers
9.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VCOOK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, punitive, or exemplary damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury, illness, allergic reactions, or death resulting from recipe use
- Property damage or loss resulting from cooking activities
- Unauthorized access to your account or data
- Errors or omissions in AI-generated content
MAXIMUM LIABILITY: In no event shall VCook's total liability to you for all claims exceed the amount you paid to VCook in the 12 months preceding the claim, or $100 USD, whichever is greater.
9.6 Indemnification
You agree to indemnify, defend, and hold harmless VCook and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights (including intellectual property rights)
- User Content you create or share
- Health outcomes or injuries resulting from following recipes
10. Termination
10.1 Termination by You
You may terminate your account at any time by:
- Opening VCook → Settings → Account Management
- Tapping "Delete Account"
- Confirming your decision
Upon deletion:
- Your account, recipes, and personal data will be permanently deleted within 30 days
- You will lose access to premium features immediately
- Shared recipes will remain accessible to recipients (they receive a copy, not a reference)
- Your subscription will not be automatically canceled (you must cancel separately through iOS Settings)
10.2 Termination by VCook
We reserve the right to suspend or terminate your account immediately, without notice, for:
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent or illegal activity
- Abuse of service limits or attempts to circumvent restrictions
- Harassment of other users or our support team
- Security threats or unauthorized access attempts
- Chargebacks or payment disputes
Upon termination by VCook:
- You will lose access to the App and all content
- No refunds will be provided for remaining subscription time
- You may not create a new account without our permission
10.3 Effect of Termination
The following sections survive termination:

- Disclaimers and Limitations of Liability (Section 9)
- Indemnification (Section 9.6)
- Dispute Resolution (Section 11)
- Governing Law (Section 12)
11. Dispute Resolution and Arbitration
11.1 Informal Resolution
Before filing a claim, you agree to contact us at vcook.innovation@gmail.com to attempt to resolve the dispute informally. We will try to resolve disputes in good faith within 30 days.
11.2 Binding Arbitration
If informal resolution fails, any dispute arising from these Terms or your use of VCook shall be resolved through binding arbitration, except as noted below.
Arbitration Rules:
- Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- Arbitration will take place in [Your State/Country] or remotely via video conference
- The arbitrator's decision is final and binding
- Each party pays their own legal fees unless the arbitrator awards fees to the prevailing party
11.3 Class Action Waiver
YOU AND VCOOK AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
- All disputes must be brought individually
- You may not join or consolidate claims with other users
- You may not participate in class-wide or representative actions
11.4 Exceptions to Arbitration
The following disputes are not subject to arbitration:
- Intellectual property disputes (copyright, trademark infringement)
- Small claims court actions (if within jurisdictional limits)
- Injunctive relief to prevent unauthorized use or abuse
11.5 Opt-Out of Arbitration
You may opt out of arbitration by sending written notice to vcook.innovation@gmail.com within 30 days of first accepting these Terms. Your notice must include your name, email, and a statement that you opt out of arbitration.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of [Your State, e.g., California, United States], without regard to conflict of law principles.
If arbitration does not apply, you agree to the exclusive jurisdiction of the state and federal courts located in [Your County/State] for resolution of disputes.
13. Apple App Store Terms
VCook is distributed through the Apple App Store. Additional terms apply:
13.1 Apple's Role
- Apple is not a party to these Terms; the agreement is between you and VCook
- VCook, not Apple, is solely responsible for the App and its content
- Apple has no obligation to provide support or maintenance for the App
- Apple is not responsible for any claims related to the App (including product liability, legal compliance, or intellectual property infringement)
13.2 License Scope
The license granted to you is limited to a non-transferable right to use VCook on Apple devices you own or control, as permitted by Apple's App Store Terms of Service.
13.3 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
13.4 Apple EULA
If you subscribed to VCook through the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
14. Modifications to the Service
We reserve the right to modify, suspend, or discontinue VCook (or any features) at any time, with or without notice, for reasons including but not limited to:
- Technical improvements or upgrades
- Changes to third-party service availability
- Legal or regulatory requirements
- Business decisions
We are not liable for any modification, suspension, or discontinuation of the Service.
15. Changes to These Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last Updated" date at the top of this page
- Material changes will be communicated via in-app notification or email
- Continued use of the App after changes are posted constitutes acceptance of the new Terms
- If you do not agree to the new Terms, you must stop using the App and may delete your account
16. General Provisions
16.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and VCook and supersede all prior agreements or understandings.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.3 No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
16.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any successor entity (e.g., in a merger or acquisition).
16.5 Force Majeure
We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, pandemics, wars, cyberattacks, or third-party service outages.
16.6 Export Compliance
You may not use or export VCook in violation of U.S. export laws or regulations. By using VCook, you represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country.
16.7 Feedback
If you provide feedback, suggestions, or ideas to VCook, you grant us a perpetual, worldwide, royalty-free license to use that feedback without compensation or attribution.
